Our attorneys have successfully litigated and won trials involving breach of contract, trade secret, business torts, officer and director liability, and a wide variety of business litigation matters. Recently our firm successfully defended nine securities class action lawsuits brought nationwide following the merger of two large publically traded oil and gas companies, which allowed the merger to consummate on time and to the betterment of the national shareholders of both companies. Construction Litigation. We are proud to represent both general contractors and sub-contractors in construction claims around the State of Oklahoma. We recently won a jury verdict of $1 Million dollars in favor of a local subcontractor in a construction related claim. We regularly represent general contractors by tendering claims to subcontractors, reviewing contracts with owners and subcontractors, and aggressively defending them in all types of construction claim losses. Employment Litigation. In addition to consulting businesses with regard to how to avoid litigation arising out of employment matters, the Firm regularly defends claims involving wrongful termination, retaliatory discharge, ERISA, FMLA and COBRA. One of our shareholders serves the local federal court as an Adjunct Settlement Judge and presides over all types of employment law claims, which gives our firm an unusual expertise and insight when we represent a party in employment law litigation of any kind. Insurance Defense. Our firm is one of the premier insurance defense firms in the state. We regularly handle third party and first party claims for all of the major insurance carriers. We serve as national panel counsel for catastrophic injuries for one of the world’s leading insurance carriers, regularly defending general commercial liability claims in excess of $1 Million dollars. Products Liability. Manufacturer’s Strict Products Liability is a serious claim. It is all or nothing. Our firm has never lost a products case and we have represented manufacturers all over America and Canada in claims in Oklahoma. Members of our firm were formerly with the law firm that wrote the book on products liability in Oklahoma by prevailing in the Oklahoma seminal case of Kirkland v. General Motors. Subrogation. One of our unique niches is representing Insurance Companies to go after other third-parties to recover money paid out in settlement of a claim. In the year 2010 alone, in just two cases our firm recovered close to $1 Million dollars for a major national insurance company. Environmental. Two members of our litigation team have tremendous experience in representing clients in CERCLA, FIFRA, and other environmental claims, and were among the lead counsel for two Superfund Cleanup sites in Oklahoma. Oil and Gas. The business unit of our firm is proud to have several major oil and gas related companies as clients of the firm. Our litigation team regularly has to go to bat for those clients in various types of oil and gas contract dispute litigation, royalty disputes, take or pay claims, and other claims unique to this industry. Real Estate Litigation. We are fortunate to have the combination of members of our firm whose expertise is transactional real estate, and litigators who understand the issues. One of our firm’s major clients is the nation’s largest cell tower management company, and our litigation team serves as outside regional trial counsel for very complicated real estate litigation and condemnation issues. OSHA. We are one of the few law firms in the Tulsa area that has actively litigated OSHA claims with the Department of Labor. We know the field investigators. We have represented and counseled with local companies on their OSHA compliance issues. We have relationships with private safety training companies to ensure our clients are fully protected from OSHA citations and if or when a citation is issued, we know how to successfully defend and resolve it in our client’s favor. Close × Estate Planning Estate Planning. The Firm assists clients with basic to complex estate planning. This commonly involves the use of a will and/or trust. We work with clients to identify goals, anticipate future concerns, and formulate a plan that will accomplish that client’s objectives. We frequently advise clients on issues such as minimizing the effect of taxes upon an estate, planning for a blended family, and business succession planning. Our Firm has found that while many people find it difficult to address end-of-life issues, those who take the time to create an estate plan make it much easier for their survivors to address the various financial issues created by the loss of a loved one. Business Succession Planning. Clients frequently have a large amount of their assets in a family business or closely held company. The Firm has counseled numerous clients regarding planning for business succession after the death of an owner. This can be an important step in making sure that a business continues to run smoothly after the death of an owner. This type of planning also addresses whether and how a decedent’s loved ones will receive an interest in the business. Unfortunately, the failure to plan for such an event can be very harmful to the success and existence of a small business. Tax-Exempt Organizations. While many people associate estate planning with asset distribution, one of the most pressing concerns for young parents is, “What will happen to my children if I pass away?” The Firm regularly assists clients in guardianship planning for minor children, in order to identify who will care for the children in the event both parents pass away. Younger clients report that this is frequently one of the most important aspects of creating an estate plan. Probate. While the use of a trust may avoid the probate process, in some cases probate is a necessity (and a good thing). The Firm regularly handles probate matters. Probate is frequently necessary in order to distribute property pursuant to the terms of a will. During the probate process, a party may also object to the validity or enforceability of a will. The Firm has represented clients in cases involving claims of undue influence and lack of testamentary capacity. An administration (a judicial proceeding similar to a probate) may also be necessary when a person dies without a will. In such cases, the Court will distribute the decedent’s property according to Oklahoma statutes. Our attorneys have experience representing the various parties involved in this process, including the personal representative of the estate and heirs with claims to the decedent’s estate. Health Care Documents. National events have highlighted the need for an individual to execute health care documents. These include an Advance Directive (also known as a Living Will) and a Durable Power of Attorney for Health Care. The Firm recommends including these documents in an estate plan. After receiving his law degree from the University of Tulsa in 1983, Paul served as a law clerk for United States District Court Judge Roy W. Harper in St. Louis, Missouri. He then was an associate with the Greensfelder, Hemker & Gale firm in St. Louis, followed by a move to the Kansas City firm of Cooling & Herbers where he later became a shareholder. Paul moved back to Tulsa in 1994, joining the firm of Stuart, Biolchini, Turner & Givray, where he was a partner. Paul joined Johnson & Jones in 2004. Ms. Eschenheimer's practice focuses on catastrophic injury, transportation and business litigation, as well as bad faith and insurance disputes. She also litigates first and third party automobile negligence, construction defects, premises liability and products liability matters. Ms. Eschenheimer received a Bachelor of Arts degree, with distinction, from the University of Kansas in 1992 and a Juris Doctor, with distinction, from the University of Oklahoma in 1996. Early in her legal career Ms. Eschenheimer was employed in-house for a commercial property and casualty insurer supervising large exposure losses, making coverage evaluations and supervising litigation.
